The following General Terms and Conditions are valid for all contracts, deliveries and further services connected to the ordering of books. We hereby expressly object to differing regulations of the contractual partner. All side-agreements require the written permission of Gerhard Huber.
Gerhard Huber is entitled to amend or supplement these General Terms and Conditions including all possible enclosures within an appropriate period of notice at any time. Previously received orders will be processed according to the General Terms and Conditions valid at the time the order was received.
The offers made by Gerhard Huber are not binding. Small deviations and technical changes to the illustrations and descriptions are possible.
There is no minimum order quantity. All our prices include the legal valid added tax. We reserve the right to carry out partial deliveries should it appear to be advantageous for a quick processing of the order. All deliveries are made on the account of the purchaser.
In the case that more than one book is ordered at the same time, shipping costs are only calculated once. Special shipping forms requested by the customer are calculated with the customary extra charge.
Delivery usually takes around 2 -3 days. If the goods are not in stock, we will strive for a quick delivery. In the case of any failure to meet the delivery or performance dates due to force majeure, industrial disputes, unforeseeable events or any other events outside of our control, the delivery is suitably extended. In the case of failure to meet the delivery or performance dates for any other reasons than the ones mentioned above, the customer is entitled to grant a grace period by written notice and also declare therein that customer will withdraw from the contract should the delivery or performance in said contract not be met after expiration of the grace period. If the failure to meet the delivery date is due to inability of the manufacturer or sub-supplier, Gerhard Huber, as a buyer, may withdraw from the contract, as far as the agreed delivery date has been exceeded by more than 2 months. Claims for damages due to delay or inability or failure to comply, including those that were incurred up to termination of the contract, are excluded.
If you or another person should accidently send an online order, please send an informal message to the email address listed on your confirmation email without delay so as not to incur unnecessary processing costs.
The following exceptions can be returned:
Gerhard Huber guarantees that the sold products are free from material and manufacturing defects at the time of the passing of risks and comply with the contractually ensured quality.
Upon arrival of the products, the customer must inspect the products for defects as well as the quality of the products without delay. Gerhard Huber must be notified in writing of any obvious defects within 10 days after discovery of the defects. The same goes for hidden defects. If customer fails to do so, the warranty ceases to apply to these defects. In the case of complaints, the customer must prove the purchase date with an invoice. The claimed product must be sent to us with a copy of the invoice and sufficient postage.
The warranty does not cover normal wear, operating errors or abrasion. The warranty expires if the customer changes the delivered products. Gerhard Huber retains the right to repair free of charge during the warranty period. The product may be completely replaced. If the defects are not remedied within an appropriate period of time, the customer is entitled to an exchange or a price reduction.
The products remain the property of the company Gerhard Huber until full payment has been received.
Within the scope of the business process, the required data is process and stored via an electronic data processing system. Personal data will be treated as strictly confidential and will not be passed on to a third party as a matter of principle.
The use of texts from this book on own websites or in other media violates the copyright. All rights, especially the rights of reproduction and distribution as well as of translation, are reserved. No part of the books may be reproduced in any way for commercial purposes and for cross-company use without the written approval of the owner or the author, nor be stored, processed or reproduced via electronic systems. This includes publishing on the web, intranet, online services, mail boxes or other similar media.
The book and its contents can be used non-restrictively for in-company work as well as for private use.
Short extracts can be used without prior permission, if they are used as part of other publications or, e.g. on slides during a seminar. The source must be stated accordingly.
Place of performance and jurisdiction for both parties is the seat of Gerhard Huber. This agreement is subject exclusively to the laws of the Republic of Austria.
